الملخص
تناولت هذه الدراسة موضوعاً جوهرياً في القانون الإداري العراقي، وهو "هيكلية اختصاص الإداري وحدود السلطة التقديرية"، حيث تبرز أهمية البحث في ظل تزايد الدور الرقابي للقضاء الإداري على تصرفات الإدارة. هدفت الدراسة إلى تأصيل مفهوم ركن الاختصاص كقاعدة آمرة متصلة بالنظام العام، والتمييز بينه وبين السلطة التقديرية التي تمنح للإدارة مرونة في اتخاذ القرار. اعتمد البحث على المنهج التحليلي التأصيلي من خلال استقراء نصوص قانون مجلس الدولة العراقي رقم (65) لسنة 1979 المعدل، وتحليل قرارات محكمة القضاء الإداري.وقد لخص البحث إلى مجموعة من النتائج، أبرزها: أن السلطة التقديرية في التشريع العراقي ليست سلطة مطلقة، بل هي مقيدة بهدف المصلحة العامة وتخضع لرقابة القضاء عبر معايير "التناسب" و"عدم الغلو". كما كشفت الدراسة عن وجود تحديات في إثبات عيب الانحراف بالسلطة نتيجة غياب النصوص الملزمة بتسبيب القرارات الإدارية في كافة الأحوال. وأوصت الدراسة بضرورة تشريع قانون موحد للإجراءات الإدارية في العراق لتعزيز الشفافية وحماية الحقوق والحريات من تعسف الإدارة في استخدام سلطتها التقديرية.

Abstract
This study addressed a fundamental topic in Iraqi administrative law: "The Structure of Administrative Jurisdiction and the Limits of Discretionary Power." The importance of this research lies in the increasing oversight role of the administrative judiciary over administrative actions. The study aimed to root the concept of the jurisdiction element as a mandatory rule related to public order and to distinguish it from the discretionary power that grants the administration flexibility in decision-making.The research adopted an analytical-inductive methodology by reviewing the texts of the Iraqi State Council Law No. 65 of 1979 (as amended) and analyzing the decisions of the Administrative Court. The research reached several key findings, most notably: Discretionary power in Iraqi legislation is not absolute but is restricted by the goal of public interest and is subject to judicial review through the standards of "proportionality" and "non-excessiveness." The study also revealed challenges in proving the "abuse of power" defect due to the absence of legal texts mandating the justification (reasoning) of administrative decisions in all cases. The study recommended the necessity of enacting a unified law for administrative procedures in Iraq to enhance transparency and protect rights and freedoms from administrative arbitrariness in the exercise of its discretionary power.
