الملخص
يتناول هذا البحث أثر الذكاء الاصطناعي في المسؤولية الجنائية من خلال دراسة مفهوم الذكاء الاصطناعي وأركان المسؤولية الجنائية، وتحليل الجرائم التي قد تنشأ عن استخدام الأنظمة الذكية، مثل الحوادث الناتجة عن المركبات ذاتية القيادة والجرائم الإلكترونية والأخطاء الطبية. كما يناقش البحث الاتجاهات الفقهية والتشريعية المتعلقة بتحديد المسؤولية، سواء كانت تقع على المبرمج أو المصنع أو المستخدم أو غيرهم، مع بيان موقف بعض التشريعات المقارنة والعراقية. ويخلص البحث إلى أن الذكاء الاصطناعي لا يتمتع حاليًا بالشخصية القانونية أو بالإرادة اللازمة لتحمل المسؤولية الجنائية، مما يستدعي تطوير الأطر التشريعية ووضع قواعد قانونية خاصة تنظم استخدامه وتحدد المسؤولية عن الأضرار والجرائم الناشئة عنه، بما يحقق التوازن بين تشجيع الابتكار وحماية المجتمع.
Abstract
This research examines the impact of artificial intelligence (AI) on criminal liability by studying the concept of AI and the elements of criminal liability. It analyzes crimes that may arise from the use of intelligent systems, such as accidents involving autonomous vehicles, cybercrimes, and medical malpractice. The research also discusses jurisprudential and legislative trends related to determining liability, whether it falls on the programmer, manufacturer, user, or others, while outlining the positions of some comparative and Iraqi legislation. The research concludes that AI currently lacks legal personality or the necessary will to bear criminal responsibility. This necessitates the development of legislative frameworks and the establishment of specific legal rules to regulate its use and define liability for damages and crimes arising from it, thereby achieving a balance between encouraging innovation and protecting society.
