ملخص البحث
تناول هذا البحث موضوع جرائم الاعتداء على العرض بين الشريعة الإسلامية
والقانون الجنائي، باعتباره من الموضوعات المهمة التي تمس كرامة الإنسان وأمن
المجتمع واستقراره. وهدف البحث إلى بيان مفهوم جرائم الاعتداء على العرض، وأهم
صورها، وبيان الأحكام الشرعية والقانونية المنظمة لها، مع إجراء مقارنة بين موقف
الشريعة الإسلامية والقانون الجنائي من حيث التجريم والعقوبة ووسائل الإثبات
وتوصل البحث إلى أن الشريعة الإسلامية أولت حماية العرض عناية خاصة، وعدّته
من الضرورات الخمس التي يجب المحافظة عليها، فوضعت أحكامًا وقائية وعلاجية تهدف
إلى منع وقوع الجريمة قبل حدوثها، من خلال ترسيخ القيم الأخلاقية، والأمر بالعفة
وغض البصر، وتحريم كل ما يؤدي إلى الفاحشة، كما شرعت عقوبات محددة لبعض الجرائم
وعقوبات تعزيرية لغيرها وفق ضوابط تحقق العدالة وتحفظ كرامة الإنسان.كما بين البحث
أن القانون الجنائي يجرم مختلف صور الاعتداء على العرض، مثل الاغتصاب وهتك العرض
والتحرش والجرائم الجنسية الأخرى، ويقرر لها عقوبات تختلف بحسب جسامة الجريمة
والظروف المحيطة بها، مع إيلاء اهتمام خاص بحماية الضحايا، ولا سيما الأطفال
والنساء، وتشديد العقوبات في الحالات المشددة.وأظهرت
الدراسة وجود أوجه اتفاق بين الشريعة الإسلامية والقانون الجنائي تتمثل في حماية
العرض وتجريم الاعتداء عليه وتحقيق الردع، مع وجود اختلافات تتعلق بمصدر التجريم،
وطبيعة العقوبات، ووسائل الإثبات، والسياسة الوقائية التي تتميز بها الشريعة
الإسلامية.وخلص البحث إلى أن
حماية العرض مسؤولية مشتركة بين التشريع والأسرة والمؤسسات التربوية والدينية، وأن
تعزيز الوعي القانوني والأخلاقي، إلى جانب تطوير التشريعات بما يواكب المستجدات،
يسهم في الحد من جرائم الاعتداء على العرض وتحقيق الأمن والاستقرار في المستقبل .

Abstract
This research examines Crimes Against
Honor (Sexual Offenses) in Islamic Sharia and Criminal Law, as they are among
the most serious crimes affecting human dignity, family stability, and social
security. The study aims to clarify the concept of crimes against honor,
identify their main forms, explain the legal and Islamic rulings governing
them, and provide a comparative analysis between Islamic Sharia and criminal
law in terms of criminalization, punishment, and methods of proof.The study
found that Islamic Sharia places great importance on the protection of honor
and chastity, considering it one of the five essential objectives (Maqasid) of
Islamic law. It adopts both preventive and punitive measures by promoting moral
values, modesty, lowering the gaze, and prohibiting all acts that may lead to
immorality. At the same time, it prescribes specific punishments for certain
offenses and discretionary penalties for others in accordance with the
principles of justice and the protection of human dignity.The research also
shows that criminal law criminalizes various forms of sexual offenses,
including rape, indecent assault, sexual harassment, and other crimes against
honor. It imposes penalties that vary according to the seriousness of the
offense and the circumstances surrounding it, while providing greater legal
protection for victims, particularly women and children.The comparative
analysis reveals that both Islamic Sharia and criminal law share the common
objective of protecting human dignity and criminalizing offenses against honor.
However, they differ in the sources of legislation, the nature of punishments,
methods of proof, and the preventive approach adopted by Islamic Sharia.The
study concludes that protecting honor is a shared responsibility of legal
systems, families, educational institutions, and society. Strengthening legal
awareness, promoting ethical values, and continuously developing criminal
legislation are essential steps toward reducing crimes against honor and
ensuring justice, security, and social stability.
