Abstract
This
study explores the role of direct constitutional litigation as a tool for
constitutional review through a comparative analysis of the United Arab
Emirates (UAE) and Kuwait. It seeks to evaluate the procedures involved in
constitutional litigation and its impact on reinforcing the rule of law while
safeguarding rights and freedoms. Adopting a comparative legal perspective, the
research examines constitutional texts and judicial rulings in both nations.
Special attention is given to the authorized judicial bodies, criteria for
admissibility, procedural timelines, and the legal implications of
constitutional judgments. The findings reveal that Kuwait offers more
flexibility by enabling individuals to file direct constitutional cases with
the Constitutional Court, thereby enhancing judicial oversight and
responsibility. Conversely, the UAE mainly depends on indirect constitutional
review through judicial referrals, which fosters legislative constancy and
upholds the supremacy of the Constitution. The study concludes that the success
of constitutional review relies heavily on each country's constitutional setup
and institutional architecture. It suggests that the UAE could benefit from
establishing an independent Federal Constitutional Court and simplifying procedural
prerequisites, while retaining institutional discipline to ensure effective
constitutional justice.
